1.About these terms

These terms are a contract between you and [LEGAL ENTITY NAME] ([COMPANY NUMBER]), of [REGISTERED ADDRESS] ("Club Maranello", "we", "us"), and govern your use of the Club Maranello app and membership.

By applying for membership or using the app, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the app.

Independence from Ferrari. Club Maranello is an independent enthusiasts' club. It is not affiliated with, endorsed by, sponsored by, or connected to Ferrari S.p.A. or any Ferrari group company. All Ferrari trade marks are the property of their respective owners.

2.Eligibility and membership

• You must be 18 or over and, at the time of applying, a UK-based owner of a Ferrari vehicle.
• Membership is by verification and invitation. We verify eligibility manually by checking your VIN and owner details against dealership records. We may accept or decline any application at our discretion, and we do not guarantee acceptance.
• Membership is personal to you and non-transferable.
• Membership tiers and any tier-based access are set and changed by us; you cannot set your own tier or verification status.

3.Your account

• Keep your login details secure and do not share your account. You are responsible for activity under your account.
• Give accurate information and keep it up to date.
• Tell us promptly at [SUPPORT CONTACT EMAIL] if you suspect unauthorised access. We recommend enabling two-factor authentication.

4.Acceptable use

You agree not to:

• claim ownership of, or seek verification for, a vehicle you do not own;
• upload false, misleading, unlawful, infringing, or offensive content;
• harass, abuse, impersonate, or spam other members, or send scam or fraudulent messages;
• attempt to access another member's data, reverse-engineer, disrupt, or probe the app's security;
• use the app for commercial solicitation except where we expressly allow it;
• scrape, copy, or redistribute other members' content or data.

We operate content moderation (including automated checks) and may remove content or restrict features to keep members safe.

5.Your content

• You keep ownership of the content you add (photos, posts, vehicle details, documents).
• Everything is private by default. When you choose to share content with other members, you grant us a non-exclusive, royalty-free licence to host, display and distribute it within the app for that purpose. This licence ends when you delete the content or your account, except for copies we must retain for legal reasons or that others have already saved.
• You are responsible for having the rights to any content you upload, and for not uploading anything that infringes someone else's rights.

6.Verification badges ("CM Verified")

A "CM Verified" badge indicates that we have reviewed ownership evidence for a particular vehicle at a point in time. It is not a guarantee of title, condition, authenticity, provenance, or value, and it is not a substitute for professional inspection or due diligence. We may remove a badge at any time, including if information changes or was inaccurate.

7.Club services — important limitations

The app offers member services. Please read these carefully.

• Valuations. Any valuation we provide is an informal, indicative estimate for guidance only. It is not a formal, insurance, or RICS-style valuation and should not be relied on for insurance, sale, finance, tax, or legal purposes.
• Concierge & sourcing. We may help source parts, services or vehicles, or make introductions. We provide reasonable care but do not guarantee availability, outcome, price, timing, or the performance of any third party we introduce. [If you charge concierge fees or take sourcing commissions, set out the fees, how they are charged, and cancellation/refund terms here — and take advice on consumer-protection duties.]
• Trusted Dealers. Dealer listings are our editorial recommendations. We are not responsible for, and do not warrant, any dealer's work, pricing or conduct. Your dealings with a dealer are between you and them.
• Ask (AI). Ask gives informational responses generated by AI. It may be incomplete or wrong and is not professional mechanical, legal, financial, tax or investment advice. Always confirm anything important with a qualified professional or an official Ferrari source.
• No financial or investment advice. Nothing in the app is investment, financial, or tax advice.
• Events. Events are provided for information. Attendance, safety, and any costs are your responsibility and, where relevant, the organiser's.

8.Third-party content

The feed may include curated content from public third-party sources (for example public Instagram posts from an admin-controlled allowlist). That content belongs to its creators; its inclusion is not an endorsement, and we are not responsible for it.

9.Availability and changes

We aim to keep the app available but do not guarantee uninterrupted service. We may add, change, suspend, or withdraw features, and we may update these terms. If we make a material change to the terms, we will give reasonable notice in the app or by email; continuing to use the app after that means you accept the change.

10.Suspension and termination

• You may leave at any time by deleting your account in the app.
• We may suspend or terminate your membership if you breach these terms, if verification cannot be maintained, or where necessary to protect members or comply with the law. Where practical we will give notice and, where appropriate, a chance to put things right.
• On termination, your right to use the app ends and we will delete your data in line with the Privacy Policy.

11.Disclaimers

The app and services are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties. We do not warrant that content, valuations, AI responses, or third-party information are accurate, complete, or fit for any particular purpose.

12.Liability

Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or for fraud).

Subject to that, and to the fullest extent permitted by law:

• we are not liable for indirect or consequential loss, loss of profit, data, or goodwill, or for decisions you make based on valuations, AI responses, dealer recommendations, or other members' content; and
• our total liability to you arising out of or in connection with the app and membership in any 12-month period is limited to [the greater of the fees you paid us in that period and £[AMOUNT] — as your solicitor advises].

13.Indemnity

The app, its design, branding, and content we create are owned by us or our licensors. You may not copy or reuse them except as the app allows. "Club Maranello" and our logo are our marks.

15.Governing law

These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have as a consumer to bring proceedings in your local courts.
